BeerPair User Agreement
I. Introduction
Welcome to BeerPair. Thank you for choosing the BeerPair application (referred to as “we,” “our,” or “the Company”). This User Agreement (the “Agreement”) sets out the terms and conditions under which you may use our application. By accessing or using the application, you confirm that you have read, understood, and agree to comply with these terms. If you do not agree with this Agreement, please do not use the BeerPair application.
II. Account Registration and Use
A. Account Creation
BeerPair utilizes device - based identification to uniquely identify each user for a seamless and secure experience. To expedite the login process, you can quickly access the application using this device - based identification feature.
While creating an account, you have the option to set a profile picture and choose a nickname. These details do not need to be based on your real - life identity. However, the nickname should adhere to the application's usage guidelines, ensuring it is not offensive, illegal, or in violation of any third - party rights.
B. Account Security
You are solely responsible for maintaining the security of your device, as access to the BeerPair application is tied to this device - based identification. Ensure that your device is protected with appropriate security measures, such as passwords, PINs, or biometric authentication.
You are accountable for all activities that occur through your device - associated account. In the event that you suspect any unauthorized access to your account or detect any security - related issues, you must notify us immediately at techlanmerg@gmail.com.
C. Account Compliance
You agree to use our application in compliance with all applicable local, national, and international laws and regulations. This includes but is not limited to laws regarding intellectual property, privacy, and data protection.
You shall refrain from any improper use of your account, such as using it for fraudulent activities, spamming, or any other activity that may harm the reputation of the application or other users. Additionally, your choice of avatar and nickname should not be used to mislead, deceive, or harass other users.
D. Restricted User Use
Eligibility Criteria
Age Requirement: BeerPair is intended for use by individuals who meet certain eligibility criteria. Primary among these is that users must be of legal age in their jurisdiction to enter into a binding agreement. Due to the content, features, and potential implications of using the application, we have a strict policy regarding minor usage.
Minor Usage Exception: If you are a minor, you generally may not use BeerPair. However, in rare circumstances, a minor may use the application only with the explicit, written consent of a legal guardian. This consent should be provided to us through a designated verification process, which may include submitting a signed form or using an approved digital consent mechanism. Additionally, the minor must be under the continuous and active supervision of the legal guardian at all times while using the application. The legal guardian will be held accountable for the minor's actions and ensuring strict compliance with all terms and conditions of this User Agreement.
Geographical Restrictions: We reserve the right to restrict the use of BeerPair to users from certain geographical regions if required by law, regulatory requirements, or for security and compliance reasons. This may include regions where there are sanctions, embargoes, or where providing the service would violate local laws. For example, if a particular country has regulations that conflict with our data storage or privacy practices, we may limit access to users in that country.
Prohibited User Categories
Previous Malicious Activity: We prohibit the use of BeerPair by individuals or entities that have been previously involved in illegal or unethical activities related to the misuse of similar platforms. This includes, but is not limited to, those who have engaged in spamming, phishing, or spreading malicious software on other online platforms. Such activities not only disrupt the normal operation of online services but also pose a significant threat to user safety and privacy.
Serious Criminal Convictions: Users who have been convicted of serious crimes, especially those related to fraud, violence, or any form of cyber - crime, may be restricted from using BeerPair. We will use available public records and our discretion to determine such restrictions. Our goal is to maintain a safe and trustworthy environment for all users, and individuals with a history of such crimes may pose a risk to the community.
Enforcement of Restrictions
Immediate Action: If we have reasonable grounds to believe that a user falls into a restricted category, we may take immediate action, including but not limited to suspending or terminating the user's account without prior notice. This is to protect the integrity of the platform and the safety of other users. For instance, if we detect signs of a minor using the application without proper consent, or if we discover that a user has a history of cyber - crime, we will act promptly.
Investigation Process: In cases where we become aware of a user's non - compliance with the eligibility criteria or suspect prohibited behavior, we will conduct a thorough investigation. This may involve reviewing user activity logs, communication records, and any available external data sources. Based on the findings of the investigation, we will decide whether to impose restrictions on the user's account. If the evidence supports the suspicion, appropriate restrictions will be put in place, which could range from a temporary suspension for minor violations to permanent termination for more severe cases.
III. Application Usage Guidelines
A. Lawful Use
The BeerPair application is intended for lawful, proper, and respectful use within the community. You are prohibited from posting, sharing, or distributing any content that is illegal, deceptive, or infringes upon the rights of others. This includes but is not limited to copyrighted material, trademarked logos, or defamatory statements.
Content that promotes violence, discrimination, or hate speech is also strictly prohibited.
B. Prohibited Activities
Unauthorized advertising, promotion, or commercial activities within the app are not allowed. This means that you cannot use the application to promote your own products or services, or those of third - parties, without our prior written consent.
You must not transmit any malicious software, viruses, worms, Trojan horses, or other harmful code through the application. Any attempt to disrupt the normal operation of the application or gain unauthorized access to its systems is a violation of this Agreement.
C. Content Review Rights
We reserve the absolute right to remove, edit, or hide any content that we reasonably believe violates these terms and conditions without prior notice to you. This includes content that is offensive, illegal, or in breach of intellectual property rights.
We also reserve the right to suspend or terminate user accounts that are found to be in violation of any terms of this Agreement. Such actions may be taken without prior notice, depending on the severity of the violation.
IV. User - Generated Content
A. Content Responsibility
You may post, share, and comment on content within the BeerPair application. However, you are solely responsible for the content you generate. You must ensure that such content does not violate any laws, regulations, or the rights of others.
You represent and warrant that you have obtained all necessary rights, licenses, and permissions to post the content you submit. This includes, but is not limited to, the right to use any images, text, or other media in your content.
B. Content Management
We reserve the right to remove, edit, or hide any user - generated content that we deem to violate these terms without prior notice. This is to ensure the integrity and compliance of the application's content.
We do not guarantee the accuracy, integrity, or quality of user - generated content. Users are advised to exercise caution when relying on such content.
V. Intellectual Property Protection
A. Application and Its Content
The BeerPair application and its entire contents, including but not limited to text, images, logos, icons, buttons, music, software, and design, are protected by intellectual property laws, including copyright, trademark, and patent laws.
Unauthorized use of any part of the application, including copying, modifying, distributing, or creating derivative works, is strictly prohibited.
B. User License
By uploading or posting content on the BeerPair application, you grant us a worldwide, non - exclusive, royalty - free license to use, reproduce, modify, publish, and distribute that content. This license is solely for the purpose of operating, promoting, and improving the application.
You retain all ownership rights to your content, but you acknowledge that we need the right to use it as described to provide the application service.
VI. Privacy Policy
Our use, collection, and sharing of your personal information are governed by our Privacy Policy, which is incorporated into these terms by reference. VII. Termination of Service
A. Termination Rights
We may terminate or suspend your access to the application at any time, without prior notice, in the event of a violation of this Agreement, or if we believe, in our sole discretion, that such action is necessary to protect the interests of the Company, other users, or the integrity of the application.
Upon termination, your account and associated data will be deleted in accordance with our data retention policies. However, we may retain certain information as required by law.
B. User Termination
You may terminate your use of our application at any time. You can do this by following the account deletion procedures available within the application.

VIII. Limitation of Liability and Disclaimer
A. Provision of the Application
The BeerPair application is provided on an “as is” and “as available” basis. We make no express or implied warranties regarding the availability, accuracy, or reliability of the application. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non - infringement.
We do not guarantee that the application will be error - free, uninterrupted, or secure.
B. Damages Compensation
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the application. This includes, but is not limited to, damages for loss of profits, data, or business opportunities.
In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid, if any, for using the application.
C. No Warranty
We do not assume any responsibility for any errors or omissions in the content of the application, or for any actions taken in reliance on such content.
You use the application at your own risk.
IX. Applicable Law and Dispute Resolution
A. Governing Law
This Agreement is governed by the laws of United States District Court for the District of Colorado without regard to its conflict of laws provisions.
B. Dispute Resolution
In the event of a dispute arising out of or in connection with this Agreement, you are required to contact us first at techlanmerg@gmail.com for resolution through good - faith consultation.
If the dispute cannot be resolved through consultation, it will be subject to the exclusive jurisdiction of the competent courts in United States District Court for the District of Colorado.
X. Amendment of Terms
We reserve the right to amend the terms of this Agreement at any time. Any amendments will be posted on the application and will take effect immediately upon posting.
It is your responsibility to review this Agreement periodically to stay informed of any changes. Continued use of the application after the posting of an amendment signifies your acceptance of the new terms.
XI. Effective Date
This "BeerPair User Agreement" becomes effective as of February 12th, 2025. In the event of any subsequent major updates, we will notify users in advance and clearly specify the effective date of the new agreement.
